Cette proposition suscite plusieurs questions :<\/p>\n<ul style=\"text-align: justify;\">\n<li>Dans un premier temps, Pr. Pallard a examin\u00e9\u00a0la justification mise en avant pour la cr\u00e9ation \u00e9ventuelle de la Cour Constitutionnelle Internationale.<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Dans un deuxi\u00e8me temps, il a examin\u00e9\u00a0la normativit\u00e9 sur laquelle repose cette proposition.<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Dans un troisi\u00e8me temps, il s&rsquo;est pench\u00e9\u00a0sur la d\u00e9mocratie qui serait prot\u00e9g\u00e9e par un droit international. Nous assistons \u00e0 un double mouvement ayant des effets r\u00e9ciproques sur les uns et les autres \u2014 l\u2019internationalisation du droit constitutionnel et la constitutionnalisation du droit international. De nouveau, une Cour Constitutionnelle Internationale est per\u00e7ue comme l\u2019institution de choix pour la protection de la d\u00e9mocratie.<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Dans un dernier temps, il s&rsquo;est interrog\u00e9\u00a0sur les principes qui seraient prot\u00e9g\u00e9s par cette Cour. Seraient-ce les \u00e9lections par lesquelles la d\u00e9mocratie s\u2019exprime? Seraient-ce les principes, comme la s\u00e9paration des pouvoirs, par lesquels l\u2019\u00e9tat de droit s\u2019exprime? Seraient-ce les droits fondamentaux de la personne, la libert\u00e9 et l\u2019\u00e9galit\u00e9?<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify;\">Pr.
